Terms of use
The terms on which a business, and the people it gives logins to, may use La Sociedad Ops.
Who these terms are between
Jorge Miguel Freitas de Oliveira trading as La Sociedad (ABN 19 574 561 595) and the person or business given a login. These terms are governed by the law of Victoria, Australia.
What La Sociedad Ops does
La Sociedad Ops is a personal-safety app for people who meet others alone as part of their work. It does three things: a check-in timer that asks whether you are out and safe when your time is up, and tells your emergency contact if you do not answer; screening a phone number against the warnings your business has recorded; and a warnings register your business keeps. It sends no messages to the people you meet, takes no payments, and shows no advertising.
Who may use it
It is for adults (18 and over), on logins given to them by the business they work with. There is no sign-up inside the app and no account is offered to the public. Every login is created by the business that holds the arrangement, and that business decides who gets one.
What it is not
La Sociedad Ops is not an emergency service and does not contact one. In immediate danger, call 000 (in Australia).
- The check-in timer, the alerts, screening and the register are aids, not guarantees. They rely on a phone with power and signal, a carrier delivering a text, and a person reading it — any of which can fail. They must never be your only precaution.
- An alert goes to the one emergency contact your business has set. If none is set, the app says so, and nobody is told.
- A screening result is what your business has on record. "Nothing on record" means exactly that: it is not a statement that a person is safe.
- The service does not guarantee that a text message or a notification is delivered.
The rules of the warnings register
A warning is one person's account of another, kept against a phone number. You are asked to agree to these rules in the app before you record your first one:
- A warning is your account of what happened with a phone number. Other people in your business will rely on it.
- Record only what happened to you, or what a named safety service told you. Never a guess, a rumour or a grudge.
- A safety category is for violence, threats or assault. It flags the number for your whole business.
- If an entry looks wrong, tell your manager from the entry itself. A manager can withdraw it; a withdrawn entry is kept on record as withdrawn, never deleted.
- Recording something you know to be false can cost you your login.
- If a crime has been committed against you, the police are the people to tell. In immediate danger call 000.
Reporting an entry. Anyone signed in can open an entry and tell their manager it looks wrong. A manager can withdraw an entry at once. If you are not signed in and believe an entry about you is wrong, write to admin@la-sociedad.club; every such message is read by a person and answered within 30 days.
Misuse. A login used to record false or abusive entries, to harass anyone, or to look numbers up for any purpose other than personal safety is removed.
Your responsibilities
- Keep your login to yourself. Sign a lost phone out from Settings on another phone, or ask your business to, and tell the business at once if you think your login has been used by somebody else.
- Use the app only in a way that is lawful where you are.
- Do not use the app to harass, threaten, track or defraud anyone.
- Say where you will be honestly when you start a check-in. It is what your emergency contact is told.
Fees
The app is free to download and has no purchases inside it. Any fee for the service is agreed in writing between the business and the operator, outside the app.
Ending access
The business can remove a login at any time, and you can ask for yours to be removed from Settings. A removed login stops working on its next request and every phone is signed out. What is erased and what is kept is set out on the account deletion page.
Availability
The service is run on a best-effort basis and may be interrupted for maintenance or by circumstances outside the operator's control. No uptime percentage is guaranteed. /health says whether the service is up.
Liability
To the maximum extent permitted by law, including the Australian Consumer Law, the operator's total liability under these terms is limited to the fees paid for the service in the 12 months before the claim arose. The operator is not liable for any indirect, consequential or special loss. Nothing in these terms excludes or limits any guarantee, condition or warranty implied by the Australian Consumer Law that cannot be excluded.
